TERMS AND CONDITIONS FOR THE SNOWBEAT MUSIC FESTIVAL

1. Organizer

Music Eggert GmbH, Paulstraße 2a, D-19249 Lübtheen (hereinafter referred to as “Organizer”).

2. Applicability of the Terms and Conditions

2.1. The Snowbeat Music Festival (hereinafter referred to as “Event”) takes place at the alpincenter & Van der Valk Hotel in Wittenburg (Federal Republic of Germany). The festival area includes the entire alpincenter & Van der Valk Hotel grounds, including the parking areas (hereinafter referred to as “Festival Grounds”).

2.2. These terms and conditions (hereinafter referred to as “Terms and Conditions”) apply between the ticket buyer and the Organizer and/or the visitor and the Organizer. By purchasing a ticket, the ticket buyer and the visitor enter into an event contract with the Organizer.

2.3. Each visitor acknowledges the rights and obligations in these Terms and Conditions.

3. Prohibition of Resale / Prohibition of Ticket Modification / Contractual Penalty

3.1. The Organizer generally agrees to the transfer of visitation rights to a third party, unless:

3.1.1. the third party is subject to a ban from the premises.

3.1.2. the visitation rights are offered at a higher price than the face value of the ticket or involve commercial or resale activities.

3.1.3. the sale is mediated, conducted, or handled by unauthorized third parties, especially internet service providers, unauthorized marketplaces, and ticket resellers (e.g., eBay).

3.1.4. the transfer is directly or indirectly related to promotional activities, unauthorized travel packages, bonuses, or contests.

3.2. Modifying the ticket (e.g., printing, altering, or otherwise changing the ticket) to deceive or disadvantage others is prohibited.

3.3. Any visitor who transfers tickets in violation of these consent conditions or modifies them as per section 3.2 shall pay the Organizer a reasonable contractual penalty of EUR 2,500 per improperly offered admission ticket or visitation right. In the event of such a violation, the Organizer is entitled to revoke the visitation rights or confiscate the ticket.

4. Arrival / Parking

4.1. Arrival at the Festival Grounds and parking are at one’s own risk. The use of a parking space on the paid parking lot belonging to the Festival Grounds is subject to the parking regulations.

4.2. The Organizer provides detailed information about arrival, alternative options, etc., in the festival information available on the internet at http://www.snowbeat.de/.

4.3. Visitors are obliged to handle the parking space, buildings, facilities, inventory, etc., on the premises with care. Damages caused by the visitor or their companions during their stay must be reported to the Organizer immediately and compensated.

4.4. The Organizer expressly points out that natural irregularities, damages, or losses (e.g., tree fruits, insects, animals, branches, etc.) may occur; the Organizer is not liable for such damages.

5. Entry Control / Access to the Festival Grounds

5.1. Access to the Festival Grounds is only possible with a valid ticket. At the entrance, the ticket must be presented, and it will be exchanged for a wristband. Visitors who leave the Festival Grounds will not be granted re-entry.

5.2. A security check may be conducted by the security personnel at the entrance to the Festival Grounds. Security personnel are instructed to perform body and bag searches. Visitors agree to this.

5.3. The Organizer reserves the right to deny a visitor entry to the Festival Grounds for important reasons, including but not limited to carrying prohibited items as per section 6, apparent severe intoxication, being under the influence of drugs, or exhibiting obviously homophobic, sexist, racist, or inhumane attitudes. Entry will also be denied in case of violation of youth protection regulations. If an important reason for entry denial exists, the ticket or festival wristband loses its validity, and the admission price will not be refunded.

6. Prohibited Items

6.1. The following items are prohibited on the entire Festival Grounds: any kind of glass bottles, other glass containers, animals/pets, all types of weapons (including technical weapons), torches, pyrotechnic items, dry ice, sparklers, sky lanterns, vuvuzelas, megaphones, commercial, political, or religious items of any kind, including banners, signs, symbols, or leaflets, as well as dangerous items of any kind.

6.2. The instructions of the security personnel must be followed. The Organizer reserves the right to issue an immediate expulsion from the event grounds in case of non-compliance.

6.3. The Organizer is entitled to temporarily store and take possession of prohibited items.

7. House Rules / Behavior Regulations / Photography and Filming

7.1. The house rules are enforced by the Organizer and its security personnel. The house or Festival Grounds rules and the FAQs of the Organizer apply on the Festival Grounds. The instructions of the Organizer’s staff must be followed. Visitors are prohibited from:

7.1.1. carrying prohibited items (section 6),

7.1.2. using physical violence against other visitors, the Organizer’s staff, or third parties,

7.1.3. throwing objects onto the stage or at other visitors,

7.1.4. performing the “Wall of Death,” “Circle Pit,” or similar activities,

7.1.5. urinating or defecating outside of the toilets,

7.1.6. painting, spraying, or soiling structural installations, walls, objects, etc.,

7.1.7. engaging in commercial trade, conducting marketing activities or advertising without prior written consent from the Organizer. Any form of advertising, i.e., promoting a product, service, worldview, or religion of a company or brand, distributing or presenting political or religious content in any form (e.g., leaflets, banners, signs, etc.), as well as attaching decorations and other items, is generally prohibited on the entire Festival Grounds.

7.1.8. entering areas and rooms not open to visitors and climbing stages, trusses, or similar structures.

7.2. Photography for private use with mobile phones is permitted. The personal rights of third parties must be respected at all times. The creation of any kind of film or audio recordings and their publication online or offline without the Organizer’s permission is prohibited. Simple digital cameras without interchangeable lenses (no professional equipment, no film cameras) are allowed.

7.3. The Organizer may expel visitors who violate the behavior regulations or prohibitions in sections 5.3, 6, and 7.1., 7.2. from the Festival Grounds and issue a house ban. If a visitor commits a criminal offense at the Electric Sea Dance Festival (e.g., drug trafficking, bodily harm, theft, sexual assault, etc.), the visitor will be immediately and without warning expelled from the Festival Grounds and the incident reported to the police.

7.4. If there is an important reason and the Organizer expels the visitor from the event location, the ticket or festival wristband loses its validity, and the admission price will not be refunded. Anyone who culpably violates these Terms and Conditions is liable to the Organizer for any resulting damages.

8. Cancellation or Termination of an Event / Program Changes

8.1. If the Snowbeat Music Festival is canceled, there is a claim for reimbursement of the ticket price excluding the pre-sale fee.

8.2. The Snowbeat Music Festival will take place in all weather conditions; however, if weather conditions pose a danger to the life, health, or safety of visitors, artists, or staff, the festival will be immediately terminated. In such cases, as well as in the event of termination of the festival for other reasons of force majeure, due to official orders or court decisions, there is no claim for reimbursement or compensation, unless the Organizer is at fault for intent or gross negligence.

8.3. If the performance by the Organizer becomes impossible or delayed due to weather conditions, official orders or court decisions, or other unforeseeable and unavoidable circumstances (e.g., labor disputes, operational disruptions, transport obstacles, official measures – each also applicable to the Organizer’s contractual partners), the Organizer is entitled to cancel the event; in this case, a refund of the ticket price is excluded.

8.4. Liability for consequential damages due to the postponement and cancellation of the event is excluded.

8.5. The Organizer has no influence on the design, length, and content of individual performances and therefore assumes no liability to the visitor for this.

8.6. A ticket entitles the holder to attend a variety of concerts and accompanying events on the Festival Grounds. In case of program changes, cancellation of individual shows or program points, or the removal of individual concerts from the program, including so-called headliners, the visitor has no claims against the Organizer as long as the changes are within a certain range and the overall character of the Snowbeat Music Festival is maintained. Delays and relocations of individual program points must be accepted by the visitor. The Organizer will announce changes immediately on www.facebook.com/snowbeat.

9. Health Impairment Due to Noise

9.1. The visitor is aware that there is a special level of noise at the Snowbeat Music Festival, especially in front of the stages, and that there is a risk of possible health damage, especially hearing damage. The Organizer ensures through suitable technical equipment, volume limitation, and the selection of individual event locations that the visitor does not suffer damage from the sound level of the performances. Regardless, it is strongly recommended to use earplugs, especially when staying near the loudspeaker boxes, and to choose a place in front of the respective stages that is conducive to individual hearing habits.
